PLEASE READ BEFORE SUBMITTING AN OFFER TO PURCHASE TRUST PROPERTY.

The properties listed on this page are classified as “trust property”—tax foreclosure properties that did not sell at a Sheriff’s sale and were “struck off” to the lead plaintiff taxing unit. These properties are held in trust for the benefit of other taxing units until they are sold through a private or public offer.

This list is regularly updated as new properties are struck off or successfully purchased through the trust property offer process.

Offer & Purchase Process
  • We cannot give you advice about what amount to offer for any property; you must make your own determination of value.
  • Your offer will include all court and sale costs associated with the tax foreclosure, including:
  • $500.00 publication fee
  • $34.00 deed fee
  • After these fees are deducted, the remaining amount will be distributed to the taxing entities in proportion to their share of the taxes owed.
  • Approval Requirements:
  • Offers greater than or equal to 100% of the taxes due in the foreclosure judgment must be approved by the governing body of the lead plaintiff taxing unit.
  • Offers below 100% must be approved by all taxing units with an interest in the property.
  • All approvals must comply with the Texas Open Meetings Act before action can be taken on an offer. Most taxing units only meet once or twice each month, which determines how long it will take for your offer to be considered.

If your offer is approved, you must pay this office in cash or certified funds within ten (10) days from the date of approval. You will receive a quitclaim deed, signed by the presiding officer of each taxing unit with an interest in the property.
